Terms and Conditions

Booking Deposit and Payment: The Client shall make a booking fee as per to hold spot. Fee is Non-Refundable. (Scroll down for more information on refund policy).

The client agrees and understands that no party other than Photographer may take pictures of any poses, lighting situations, or setup made by the Photographer.

Photographic Materials and Copyright: All photographic material, such as original negatives, photos, or slides, shall be property of the Photographer. The Photographer shall own the copyright in all images created and my use the work samples, contests, exhibition, advertising and self-promotion. Usage outside the bounds of this agreement will require the Clients consent.

Clients Usage: The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer. If the Client is obtaining print for reproduction, Photographer authorizes Client to reproduce the prints only as set forth under Social Usage Requirements.

Failure to Perform: If the Photographer cannot perform this Agreement due to an accidental cause, strike, or other cause beyond the control of the parties, or due to the Photographer's illness, than the Photographer shall return any funds previously paid to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to preform for any reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client's order.

Liability: It is client's responsibility to take care of the children; Allison Bratton Photography will not accept any responsibility due to any accident to children or damage to public or private properties during the photo shooting or consultation sessions.

It is understood that no other photographer, amateur pr professional, shall be allowed at the location while Allison Bratton Photography is working, and that any breach of this Agreement will constitute a reason for non-completion of the job with no liability to the Photographer and loss of inital deposit by the client.

It is understood that Photographer is not responsible to fix photos to cover parts of your body that you do not wish to be seen in the photo, unless it was confirmed with the photographer in writing.

The photographer will be allowed one 20 minutes break (bathroom break) for sessions longer than 2 hours.
It is understood that it is clients responsibility to inform the Photographer by email for any date or location changes ( including and not limited to wedding dates, baby delivery for birth or baby delivery for hospital photography).

Photo Cooperation: In the event that the family / guests are taking photos, Allison Bratton Photography is not responsible for obstructed photos or photos ruined due to separate flashes going off or due to activities by other vendors and venue staff.

All the communications with the Photographer shall be made in English and in Writing (Text or Email).

Return and Refund Policy

My goal at Allison Bratton Photography, is to meet and exceed your expectations from the start!

Since Allison Bratton Photography provides non-tangible irrevocable goods and services I do not issue refunds once the session or event is booked. If you need to reschedule your portrait session, please let Allison know ASAP to see if you can move your session fee to cover a different day or time. You may risk losing your booking fee if date has been in high demand or if you do not reschedule.

Upon booking your session or event, Allison Bratton Photography will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, payments are non-refundable even if the date is changed or if the event becomes cancelled for any reason.

However, I do realize that exceptional circumstances can take place.

Therefore, I DO honor requests for the refund on the following reasons:

Non-delivery of the product: in the unlikely event that the photographer is injured or becomes too ill to photograph a booked session or event, the photographer will make effort to secure a replacement photographer if need be. If the situation should occur and a suitable replacement is found, responsibility and lability is limited to the return of all payments received for the session. The photographer takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond the photographer's control, photographer's liability is limited to the return of all payments received for the session. The limit of liability for a partial loss of originals shall be a prorated amount of the exposure lose based on the percentage of total number of originals.
